Uncontested Divorce

Spouses who agree to divorce and have no future financial obligations between them may be eligible to file an uncontested divorce “on papers only”, i.e., without a Settlement Agreement. The cost savings can be significant. The process, in brief, is as follows:

  1. After the initial complimentary phone consultation, the client completes an uncontested divorce intake form.

  2. The initial papers are drafted for the client’s review, including the Affidavit of Plaintiff and Verified Complaint for the client to sign and the Affidavit of Defendant for their spouse to sign.

  3. File the summons with notices and purchase an index number. Once the client’s spouse consents to the electronic filing, the client provides a copy of the Defendant’s Affidavit to their spouse to sign before a notary public.

  4. The client signs the Plaintiff’s Affidavit and the Verified Complaint before a notary public.

  5. All original documents are returned and the uncontested divorce packet is prepared and filed.

  6. Wait for the court’s review. If all is in order the court should dispose of the case and provide the judgment of divorce judgment in approximately 4-6 months, depending on the county.
